I hope you are all well and have had some time to enjoy the sunshine over the last few days.  For this edition of E-News, I wanted to provide a reminder to our employer members to make sure they remain informed regarding implementation of the Portable Long Service Scheme in Victoria.  On 1 January 2020, the new scheme will become operational.

Whilst ELAA remains a strong advocate for fair, equitable and sustainable working conditions for sector staff, the consultation, design and implementation of the new Portable Long Service Scheme has been inadequate.  On 16 October 2019, an email was circulated by Industrial Relations Victoria (IRV) that stated “Due to an administrative error in the making of the Long Service Benefits Portability Regulations 2019 (the Regulations), the Minister for Industrial Relations, Tim Pallas MP, has determined that the Regulations be revoked and re-made”.  The scheme will still be implemented on 1 January 2020 utilising the existing regulations, but in the background a review will be undertaken to re-scope the regulations.  This review will be completed by November 2020.

In the email from IRV, an invitation was provided to stakeholders to provide feedback on the new scheme and associated regulations.  ELAA’s response can be found here , with our main concerns being:

  • inadequate sector consultation
  • inequity of application with private sector employers excluded
  • increased administration and financial costs to employers
  • risks to quality outcomes and successful implementation of the kindergarten expansion program.
