20 MayLong Service Portability – DET response to questions on notice

At the Long Service Benefits Portability Scheme Information Forum held on 7 May, the Victorian Department of Education and Training took a number of questions from attendees on notice and committed to providing a response.

The Long Service Benefits Portability Act 2019 provides for portability of long service benefits to early childhood education and care workers in a range of community services, including licensed children’s services under the Children’s Services Act 1996 or approved providers under the Education and Care Services National Law (Victoria).

It is proposed that the scheme commences from 1 January 2020 and the draft regulations and regulatory impact statement (RIS) are now available for feedback until 31 May 2019.

Attached are the DET responses received on the 16 May. Key questions (among others) included:

Will early childhood advisers and educational leaders be covered by the Scheme?

Will the levy affect WorkCover premiums or super contributions?

If the provider employs a cleaner, is the cleaner covered by virtue of Schedule 2 of the Act?

Will the Authority advise a community services sector employer if they have made a payment to an employee?

If the provider employs a cleaner, is the cleaner covered by virtue of Schedule 2 of the Act?
