There have been recent changes to the Fundraising Exemption Order in Victoria which early years services should take note of …

The new Exemption Order facilitates low value fundraising appeals and ensures there is no unnecessary burden on organisations. The new Exemption Order provides for two different exemptions from the Fundraising Act 1998 (the Act).

  1. Individuals and organisations do not need to register under the Act to conduct fundraising appeals, but must otherwise comply with all the requirements in the Act, if they:
  • receive less than $20,000 gross in a financial year from fundraising;
  • are not paid for conducting a fundraising appeal (except for reimbursement of direct out of pocket expenses); and
  • use only volunteers.
  1. The new Exemption Order exempts the following organisations from part 3 of the Act:
  • organisations who are approved licensees or providers under the Children’s Services Act 1996 (Vic), or approved providers of education and care services under the Education and Care Services National Law Act 2010 (Cth) that receive funding for a kindergarten program from the Secretary to the Department of Education and Training; and
  • the Cancer Council Victoria.
