Early childhood services have been a part of the portable long service benefits scheme since 1 January 2020. The scheme is currently supported by Interim Regulations which expire on 6 November 2020. Draft permanent regulations are now available for public consultation. The aim is to ensure that the regulations provide enough clarity to employers and workers about who is included in the scheme and how the scheme will operate ongoingly. The most significant change is the abolition of the employee predominance test for the community services sector which includes early childhood services, and replacing it with a test based on award coverage. ELAA will be making a submission on behalf of members on the draft regulations and the regulatory impact assessment.
